Servidumbre de conservación: TNC y FORECOS

Bajo una herramienta legal –voluntaria y vinculante- conocida como servidumbre de conservación, se busca que un tercero custodie el cumplimiento del plan de conservación a perpetuidad de la Reserva Costera Valdiviana (RCV), una herramienta muy común a nivel internacional, pero hasta ahora y en la práctica, poco implementada en Chile para asegurar la conservación en áreas protegidas privadas.

Un gran paso para asegurar la conservación en el largo plazo de las 50 mil hectáreas que conforman la Reserva Costera Valdiviana (RCV) ubicada en las comunas de Corral y La Unión en la región de Los Ríos, se realizó el 29 mayo cuando The Nature Conservancy firmó la más grande servidumbre de conservación de Chile con Fundación FORECOS, quien será la institución que velará por el cumplimento de los compromisos actuando como una figura conocida internacionalmente como Land Trust de conservación.

lara-firmaMaryann Ramírez, Gerente de Conservación de The Nature Conservancy (TNC), explicó que este representa uno de los hitos más importantes para el proyecto de la Reserva Costera Valdiviana, ya que “este es un instrumento que nos permite asegurar la conservación a perpetuidad. Esto significa que aunque exista un dueño distinto en un futuro lejano, la Reserva no podrá tener otro destino que no sea la protección del patrimonio natural existente en la misma. La novedad en este caso es incorporar a un Land Trust, que custodia el cumplimiento de esta servidumbre”.

El Administrador y Coordinador de la RCV, Alfredo Almonacid, agregó además que “esta herramienta que se acuerda mediante escritura pública, establece condiciones y/o restricciones de uso y de continuidad de actividades para la Reserva, pero que están acordes a nuestros objetivos de conservación, y que nos han valido ser considerados uno de los mejores ejemplos de conservación privada del mundo. Para mantener esta categoría, debemos hacer todos los esfuerzos que sean necesarios, dando también un ejemplo a nivel nacional de máxima protección para áreas privadas de este tipo a través de herramientas como esta servidumbre”.

Asimismo, Almonacid señaló que “FORECOS ha sido la organización que decidió enfrentar el desafío de acompañarnos en custodiar la Reserva Costera Valdiviana, siendo una Fundación local sin fines de lucro dedicado a la investigación, con el cual compartimos la visión y el modelo de conservación que hemos implementado en la Reserva, y que por su seriedad y capacidades técnicas, entrega garantías de que podrán supervisarlo a largo plazo de la mejor manera”.

En este sentido, Christian Little, Vicepresidente de FORECOS, valoró la intención de la RCV de ser pioneros en utilizar esta herramienta. “Seremos los encargados de revisar y dar garantía que se cumplan las restricciones de conservación por medio de evaluaciones anuales, bianuales y cada cinco años con diversos métodos. Para nosotros es un gran desafío, y aspiramos a certificarnos como land trust a nivel internacional para replicar este modelo en otras áreas protegidas privadas”, comentó.

Para Antonio Lara, Presidente de FORECOS “esta servidumbre es el fruto de un intenso trabajo interdisciplinario con TNC que asegura la conservación de la RCV como un área protegida emblemática de la Eco-región de los Bosques Valdivianos Lluviosos. Nuestra expectativa es seguir aportando en el desarrollo de otras servidumbres de conservación que aprovechen esta experiencia, aprendizajes y documentos que al ser de carácter público quedan a disposición de otras iniciativas de conservación”.

En 2013 The Nature Conservancy suscribió un acuerdo con BHP Billiton para asegurar la conservación permanente de esta Reserva y la firma de la servidumbre de conservación es un paso importante para consolidar este compromiso.

Cómo funcionan las servidumbres

Las servidumbres de conservación funcionan de la siguiente manera:

Describe los aspectos naturales o productivos que el propietario desea mantener a perpetuidad tales como la mantención de la vegetación o el bosque nativo, los usos recreacionales, el hábitat de ciertas especies o una vista escénica;
Define lo que el propietario puede seguir haciendo en la propiedad, siempre y cuando sea consistente con aquello que se desea conservar;
Establece lo que el propietario definitivamente no podrá seguir haciendo en la propiedad;
Otorga a una organización el derecho a monitorear el cumplimiento de los términos fijados en el documento de la servidumbre de conservación.
